More Sotomayor and the Second Amendment

May 29, 2009

In an earlier post, I noted that Judge Sonia Sotomayor wrote, while in grad school, that the Second Amendment really doesn’t confer an individual right to bear arms.

As of five years ago, she hadn’t changed her mind:

Judge Sonia Sotomayor could walk into a firestorm on Capitol Hill over her stance on gun rights, with conservatives beginning to question some controversial positions she’s taken over the past several years on the Second Amendment.

…A 2004 opinion she joined also cited as precedent that “the right to possess a gun is clearly not a fundamental right.”

Pro-life issues have become so partisan lately that Democrats are very nearly immune to pressure from that quarter, but I’m betting the Second Amendment is different. Much different. Republicans on the Judiciary Committee must – absolutely must - ask her about this.

Oh, and from the “Tell Us Something We Didn’t Already Know” file:

…White House Press Secretary Robert Gibbs said Thursday that Obama was “very comfortable with her interpretation of the Constitution being similar to that of his.”

More from Bob Owens:

What far fewer Americans know about Obama is that he was one of the Joyce Foundation’s directors when they embarked on a plot to undermine the Second Amendment by targeting the Supreme Court of the United States.

Is a smoking gun reference appropriate in these circumstances?
